Proposed DLBC Health Facility Rule Repeal and Readoption for Rule R432-4 General Construction Open for Public Comment
The proposed rule repeal and readoption for the Health Facility Rule R432-4 General Construction, under the Utah Division of Licensing and Background Checks (DLBC), was filed in the Utah State Bulletin Vol. 2026, No. 16 and is open for public comment. Any public comment regarding this proposed rule filing can be submitted to [email protected] until September 14, 2026.

The proposed rule repeal and readoption:
- Restores essential safety standards by reinserting “Incorporations by Reference” (Section R432-4-3) for healthcare facility design.
- Consolidates general requirements into Sections R432-4-16 through 22, allowing facility-specific regulations to remain distinct without introducing new requirements.
- Clarifies the authority of the Centers for Medicare & Medicaid Services and State Fire Marshal, streamlines terminology by redefining “licensee” to include applicants, and aligns formatting with the Rulewriting Manual for Utah.
